Het “Gentrepreneur Partnership” is een samenwerking tussen Arteveldehogeschool, Universiteit Gent, HOGENT, KU Leuven – Gent, Odisee-Hogeschool en Luca School of Arts, met de steun van Stad Gent, Provincie Oost-Vlaanderen en VLAIO. Gentrepreneur Company CV is als coöperatieve vennootschap actief binnen deze samenwerking.

Deze Algemene Voorwaarden gelden tussen Gentrepreneur en de Deelnemers (zoals hierna gedefinieerd).

1. Definities ‍

        In deze Algemene Voorwaarden wordt verstaan onder:

• Activiteit(en): Een activiteit of evenement georganiseerd door Gentrepreneur.  

• Algemene Voorwaarden: Deze algemene voorwaarden.  

• Coaching(s): Een individueel adviesgesprek of een adviesgesprek in groep georganiseerd door Gentrepreneur.  

• Deelnemer(s) / jij / jouw: Bezoekers of gebruikers van een Website, deelnemers aan onze Activiteiten en gebruikers van onze Diensten.

• Diensten: Alle door Gentrepreneur aangeboden diensten, waaronder maar niet beperkt tot Coachings, inschrijvingen voor Activiteiten, informatievoorziening en netwerkactiviteiten.

• Gentrepreneur / wij / ons: de rechtspersoon die handelt onder de Gentrepreneur-naam of de betrokken Diensten / Activiteiten / Website aanbiedt, organiseert of beheert. Hierbij kan het over één of meerdere van volgende rechtspersonen gaan:  

• Gentrepreneur Company (CV), 0633.692.189, Hoogpoort 15, 9000 Gent

• Universiteit Gent (openbare instelling met rechtspersoonlijkheid), 0248.015.142, Sint-Pietersnieuwstraat 25, 9000 Gent

• Arteveldehogeschool (VZW), 0474.120.360, Hoogpoort 15, 9000 Gent  

• Hogeschool Gent, (openbare instelling met rechtspersoonlijkheid), 0255.647.755, Gerard de Duivelstraat 5, 9000 Gent

• Website(s): Een Website beheerd door Gentrepreneur of via dewelke Gentrepreneur Diensten aanbiedt, waaronder www.gentrepeneur.gent, www.gentrepreneur.be en https://gentrepreneur.startium.be.

2. Toepasselijkheid

1. Deze Algemene Voorwaarden zijn van toepassing op alle aanbiedingen, overeenkomsten, Activiteiten en Diensten van Gentrepreneur, alsook op het gebruik van onze Websites.

2. Door gebruik te maken van de Diensten van Gentrepreneur, deel te nemen aan een Activiteit of een Website te gebruiken, aanvaard je deze Algemene Voorwaarden en de toepassing ervan.

3. Afwijkingen van deze Algemene Voorwaarden zijn slechts geldig indien deze uitdrukkelijk schriftelijk zijn overeengekomen.

4. Indien één of meerdere bepalingen in deze Algemene Voorwaarden nietig zijn of vernietigd worden, blijven de overige bepalingen volledig van toepassing.

3. Website en online Diensten

1. Gentrepreneur streeft ernaar de Website en online Diensten zo veel mogelijk beschikbaar te stellen, maar kan niet garanderen dat deze te allen tijde zonder onderbrekingen of storingen zullen functioneren.

2. Gentrepreneur streeft ernaar alle informatie op de Website en in andere communicatie zo accuraat en actueel mogelijk te houden, maar kan niet garanderen dat deze informatie te allen tijde volledig, juist of actueel is. 

3. Gentrepreneur behoudt zich het recht voor om de Website of online Diensten tijdelijk buiten gebruik te stellen voor onderhoud, aanpassingen of verbeteringen.

4. De Deelnemer is zelf verantwoordelijk voor het gebruik van de juiste apparatuur en software om toegang te krijgen tot de Website en online Diensten.

5. Het is niet toegestaan om:

• De beveiliging van de Website of online Diensten te omzeilen of te kraken;

• Foute informatie te verstrekken via de Website (bv. bij aanmaak van een profiel);

• De Website of online Diensten te gebruiken op een wijze die het functioneren ervan kan belemmeren of beschadigen; en

• Geautomatiseerde programma's, zoals bots of scrapers, te gebruiken om toegang te krijgen tot de Website of online Diensten.

6. Het gebruik van sommige Websites (bv. gentrepreneur.startium.be) kan onderworpen worden aan bijkomende gebruiksvoorwaarden. Die specifieke gebruiksvoorwaarden gelden bovenop deze Algemene Voorwaarden.

7. Gentrepreneur is niet verantwoordelijk voor de juistheid, volledigheid of betrouwbaarheid van informatie die door andere Deelnemers of derde partijen op haar Websites wordt gedeeld. Alle informatie die door derden wordt verstrekt, valt onder de verantwoordelijkheid van de betreffende derde partij en niet onder die van Gentrepreneur. Daarnaast is Gentrepreneur niet aansprakelijk voor evenementen of activiteiten die door derde partijen, zoals sponsors, worden georganiseerd en die via een Website worden gedeeld.

4. Diensten en Activiteiten

1. De inhoud, data, tijden en locaties van Activiteiten worden via de Website, nieuwsbrieven of andere communicatiekanalen van Gentrepreneur bekendgemaakt.

2. Gentrepreneur behoudt zich het recht voor om wijzigingen aan te brengen in het programma, de inhoud, data, tijden of locaties van Activiteiten. Dergelijke wijzigingen geven de Deelnemer geen recht op enige schadevergoeding.

3. Gentrepreneur streeft ernaar accuraat en actueel advies te geven tijdens de Coachings, maar kan niet garanderen dat gedeeld advies of informatie te allen tijde volledig, juist of actueel is. Het advies verstrekt tijdens een Coaching vormt een persoonlijk advies van een Gentrepreneur-coach of -medewerker. De Deelnemer kan Gentrepreneur of de Gentrepreneur-coach of -medewerker niet aansprakelijk stellen voor onvolledig, verouderd of niet-accuraat advies.  

4. Gentrepreneur behoudt zich het recht voor om te weigeren Diensten (waaronder Coachings) te verstrekken aan bepaalde personen om ethische redenen, waaronder maar niet beperkt tot gevallen waarin het gedrag of de bedrijfsplannen van de persoon in strijd zijn met de waarden en normen van Gentrepreneur. Gentrepreneur zal in dergelijke gevallen, indien mogelijk, de betrokken persoon op de hoogte stellen van de reden voor de weigering.

5. Inschrijvingen en annuleringen

1. Hoewel Gentrepreneur zich voor haar Activiteiten primair richt op ondernemende Gentse jongeren tussen 18 en 25 jaar, of personen aan een hogere onderwijsinstelling met campus in Gent, staat deelname aan Activiteiten in principe open voor iedereen, tenzij anders vermeld. Gentrepreneur kan specifieke toelatingscriteria hanteren voor bepaalde Activiteiten of Diensten. Deze criteria worden vooraf gecommuniceerd.

2. Voor deelname aan bepaalde Activiteiten is voorafgaande inschrijving vereist. Inschrijving geschiedt via de Website, een inschrijvingswebsite, per e-mail of op andere door Gentrepreneur aangegeven wijze.

3. Een inschrijving is pas definitief na bevestiging door Gentrepreneur. Gentrepreneur behoudt zich het recht voor om inschrijvingen te weigeren zonder opgave van redenen.

4. Bij inschrijving voor evenementen of Activiteiten verwacht Gentrepreneur de aanwezigheid van de Deelnemer. Indien de Deelnemer verhinderd is, dient de Deelnemer dit zo spoedig mogelijk te melden aan Gentrepreneur.

5. Annulering door de Deelnemer dient per e-mail te geschieden of via de wijze aangegeven op de Website (bv. annuleringslink). Bij laattijdige of niet-annulering door de Deelnemer behoudt Gentrepreneur zich het recht voor een redelijke annuleringsvergoeding aan te rekenen. Bij herhaalde niet-aanwezigheid kan Gentrepreneur de inschrijving van een Deelnemer weigeren of annuleren.

6. Gentrepreneur behoudt zich het recht voor om Activiteiten te annuleren indien er onvoldoende aanmeldingen zijn of in geval van overmacht. In dat geval worden eventuele deelnamekosten gerestitueerd.

7. Gentrepreneur behoudt zich uitdrukkelijk het recht voor om personen toegang tot Activiteiten te weigeren of te verwijderen zonder opgave van redenen, bijvoorbeeld bij:

• Ongepast of storend gedrag

• Het niet naleven van aanwijzingen van medewerkers of vertegenwoordigers van Gentrepreneur

• Het bereiken van de maximumcapaciteit van een locatie

• Andere omstandigheden die naar het oordeel van Gentrepreneur een belemmering vormen voor het goede verloop van een Activiteit

6. Aansprakelijkheid

1. Deelname aan Activiteiten van Gentrepreneur geschiedt geheel op eigen risico van de Deelnemer.

2. Gentrepreneur is niet aansprakelijk voor enige schade, direct of indirect, die de Deelnemer lijdt als gevolg van het gebruik van de Diensten van Gentrepreneur of deelname aan Activiteiten, tenzij de schade het gevolg is van opzet of bewuste roekeloosheid van Gentrepreneur.

3. Gentrepreneur is in het bijzonder niet aansprakelijk voor:

• Schade aan, verlies of diefstal van persoonlijke eigendommen tijdens Activiteiten

• Persoonlijk letsel of ongevallen tijdens Activiteiten

• Schade als gevolg van door Gentrepreneur verstrekte adviezen of informatie

• Schade als gevolg van het niet doorgaan of wijzigen van Activiteiten

• Schade veroorzaakt door andere Deelnemers

• Indirecte schade, gevolgschade, gederfde winst, gemiste besparingen of schade door bedrijfsstagnatie

4. De Deelnemer gaat ermee akkoord dat de Deelnemer geen rechtstreekse vordering (contractueel of buitencontractueel) kan instellen tegen een hulppersoon van Gentrepreneur, met inbegrip van, maar niet beperkt tot Gentrepreneur-coaches, -medewerkers en -experts. Voor zover nodig, doet de Deelnemer expliciet afstand van dergelijke vorderingen.  

5. Indien Gentrepreneur aansprakelijk mocht zijn voor enigerlei schade, dan is de aansprakelijkheid beperkt tot maximaal het bedrag dat de verzekeraar van Gentrepreneur in het betreffende geval uitkeert, of indien geen uitkering plaatsvindt, tot maximaal 10.000 EUR.

7. Intellectuele eigendom

1. Alle intellectuele eigendomsrechten met betrekking tot de inhoud van de Website, evenementen, presentaties, documenten en andere materialen van Gentrepreneur blijven bij Gentrepreneur of diens licentiegevers.

2. Het is niet toegestaan om zonder voorafgaande schriftelijke toestemming van Gentrepreneur:

• Materialen van Gentrepreneur te reproduceren, te verspreiden, openbaar te maken of te wijzigen

• De inhoud van presentaties, workshops of trainingen op te nemen, te kopiëren of te verspreiden

• Merken, logo's of andere onderscheidingstekens van Gentrepreneur te gebruiken

3. Het is toegestaan om materialen van Gentrepreneur te delen via sociale media, mits met bronvermelding en zonder commercieel oogmerk.
   
   ‍

8. Privacy en beeldmateriaal

1. Gentrepreneur verwerkt persoonsgegevens in overeenstemming met de geldende privacywetgeving en het privacybeleid, dat beschikbaar is op haar Websites.

2. Tijdens Activiteiten kunnen foto's, video- en geluidsopnames worden gemaakt voor promotionele doeleinden, verslaglegging en archivering. Door deel te nemen aan Activiteiten van Gentrepreneur geeft de Deelnemer toestemming voor het maken en publiceren van dit materiaal waarop de Deelnemer mogelijk herkenbaar in beeld komt.

Indien de Deelnemer niet gefotografeerd of gefilmd wenst te worden, dient de Deelnemer dit voorafgaand aan de Activiteit schriftelijk kenbaar te maken aan Gentrepreneur. Gentrepreneur zal zich dan inspannen om de Deelnemer niet herkenbaar in beeld te brengen als portret, maar kan dit niet garanderen bij algemene sfeerbeelden of opnames van grote groepen.  

3. Gentrepreneur behoudt zich het recht voor om beeldmateriaal te gebruiken voor haar eigen promotionele doeleinden via de Website, sociale media, nieuwsbrieven en andere communicatiekanalen, zonder dat de Deelnemer hiervoor een vergoeding ontvangt.

9. Nieuwsbrief en communicatie

1. Bij inschrijving voor de nieuwsbrief geeft de Deelnemer toestemming voor het ontvangen van periodieke updates over Activiteiten, Diensten en andere relevante informatie van Gentrepreneur.

2. De Deelnemer kan zich te allen tijde uitschrijven voor de nieuwsbrief via de daarvoor bestemde link in elke nieuwsbrief of door een verzoek te sturen naar Gentrepreneur.

3. Gentrepreneur kan de Deelnemer benaderen met gerichte communicatie over Activiteiten of Diensten die aansluiten bij het profiel of de interesses van de Deelnemer (zoals bijvoorbeeld aangegeven op het Startium-profiel).

10. Zichtbaarheid op de Website

1. Gentrepreneur biedt Deelnemers soms de mogelijkheid om zichtbaarheid te krijgen op haar Websites, sociale media, poster- en andere marketingcampagnes. Om hiervoor in aanmerking te komen, kan Gentrepreneur specifieke voorwaarden stellen, alsook deze op een later ogenblik eenzijdig wijzigen. Gentrepreneur heeft het recht om een campagne eenzijdig stop te zetten of een Deelnemer niet langer zichtbaarheid te bieden zonder verdere motivering.  

2. Gentrepreneur behoudt zich het recht voor om profielen te weigeren, te verwijderen of aan te passen zonder opgave van redenen.

3. De Deelnemer is zelf verantwoordelijk voor de juistheid en actualiteit van de aangeleverde informatie en beeldmateriaal.

4. Gentrepreneur is niet aansprakelijk voor eventuele schade die voortvloeit uit de publicatie van onjuiste of onvolledige informatie over de Deelnemer of diens onderneming.

11. Gedragsregels

1. De Deelnemer zal zich tijdens Activiteiten van Gentrepreneur gedragen in overeenstemming met de openbare orde en de goede zeden, alsook de regels van normaal maatschappelijk verkeer.

2. De Deelnemer zal aanwijzingen en instructies van medewerkers of vertegenwoordigers van Gentrepreneur opvolgen.

3. Het is de Deelnemer niet toegestaan om tijdens Activiteiten:

• Zich discriminerend, intimiderend of anderszins ongepast te gedragen jegens andere deelnemers of medewerkers van Gentrepreneur

• Materiaal te verspreiden dat in strijd is met de wet, de goede zeden of de openbare orde

• Activiteiten te ontplooien die het goede verloop van de Activiteit kunnen verstoren (bv. storende / niet-toegestane marketingpraktijken)

• Commerciële activiteiten te ontplooien (bv. een verkoopstand inrichten, banners plaatsen) zonder voorafgaande toestemming van Gentrepreneur

4. Bij overtreding van deze gedragsregels kan Gentrepreneur de Deelnemer de toegang tot de Activiteit ontzeggen of de Deelnemer verwijderen, zonder dat de Deelnemer recht heeft op restitutie of schadevergoeding.

12. Wijzigingen in de Algemene Voorwaarden

1. Gentrepreneur behoudt zich het recht voor om deze Algemene Voorwaarden te wijzigen of aan te vullen. 

2. Wijzigingen worden gepubliceerd op de Website en zijn direct van kracht. Bij substantiële wijzigingen zal Gentrepreneur de Deelnemers hiervan op de hoogte stellen via haar Website.

3. Indien de Deelnemer na wijziging van de Algemene Voorwaarden gebruik blijft maken van de Diensten van Gentrepreneur, zich inschrijft voor een Activiteit of aanwezig is op een Activiteit, wordt de Deelnemer geacht deze wijzigingen te hebben aanvaard.

13. Toepasselijk recht en geschillen

1. Op deze Algemene Voorwaarden en de toepassing ervan, en alle overeenkomsten en rechtshandelingen tussen Gentrepreneur en de Deelnemer is Belgisch recht van toepassing.

2. Bij geschillen zullen partijen eerst trachten tot een minnelijke schikking te komen. Indien dit niet mogelijk blijkt, zullen geschillen worden voorgelegd aan de bevoegde rechtbank van het gerechtelijk arrondissement Oost-Vlaanderen, afdeling Gent.

14. Overmacht

1. Gentrepreneur is niet gehouden tot het nakomen van enige verplichting indien zij daartoe verhinderd is als gevolg van overmacht of ten gevolge van omstandigheden die de uitvoering van een Dienst of Activiteit sterk bemoeilijken. Onder overmacht wordt onder meer begrepen: extreme weersomstandigheden, ziekte van medewerkers of sprekers, overheidsmaatregelen, stroomstoringen of uitval van internet- of telecommunicatieverbindingen, pandemieën of epidemieën, andere onvoorziene omstandigheden die de uitvoering van de Activiteit of Dienst onmogelijk of onverantwoord maken

2. In geval van overmacht heeft Gentrepreneur het recht om Activiteiten te annuleren, te verplaatsen of in aangepaste vorm aan te bieden, zonder dat de Deelnemer recht heeft op schadevergoeding.

15. Slotbepalingen

1. Indien één of meerdere bepalingen in deze Algemene Voorwaarden op enig moment geheel of gedeeltelijk nietig zijn of vernietigd worden, dan blijft het overige in deze Algemene Voorwaarden bepaalde volledig van toepassing.

2. In gevallen waarin deze Algemene Voorwaarden niet voorzien, zal Gentrepreneur een regeling treffen naar redelijkheid.

3. De meest recente versie van deze Algemene Voorwaarden is steeds beschikbaar op de relevante Gentrepreneur-Website

These General Terms and Conditions apply between Gentrepreneur and the Participants (as defined below).

• Activity/Activities: An activity or event organized by Gentrepreneur.

• General Terms and Conditions: These general terms and conditions.

• Coaching(s): An individual advisory meeting or a group advisory meeting organized by Gentrepreneur.

• Participant(s) / you / your: Visitors or users of a Website, participants in our Activities, and users of our Services.

• Services: All services offered by Gentrepreneur, including but not limited to Coachings, registrations for Activities, provision of information, and networking activities.

• Gentrepreneur / we / us: The legal entity acting under the Gentrepreneur name or offering, organizing, or managing the relevant Services / Activities / Website. This may concern one or more of the following legal entities:

• Gentrepreneur Company (CV), 0633.692.189, Hoogpoort 15, 9000 Ghent

• Ghent University (public institution with legal personality), 0248.015.142, Sint-Pietersnieuwstraat 25, 9000 Ghent

2. Applicability
   ‍

1. These General Terms and Conditions apply to all offers, agreements, Activities and Services of Gentrepreneur, as well as to the use of our Websites.

2. By making use of the Services of Gentrepreneur, participating in an Activity or using a Website, you accept these General Terms and Conditions and their application.

3. Deviations from these General Terms and Conditions are only valid if they have been expressly agreed in writing.

4. If one or more provisions of these General Terms and Conditions are null and void or annulled, the remaining provisions shall remain fully applicable.

3. Website and online Services

1. Gentrepreneur strives to make the Website and online Services available as much as possible, but cannot guarantee that they will function at all times without interruptions or malfunctions.

2. Gentrepreneur strives to keep all information on the Website and in other communications as accurate and up to date as possible, but cannot guarantee that this information is always complete, correct, or current.

3. Gentrepreneur reserves the right to temporarily take the Website or online Services out of use for maintenance, adjustments, or improvements.

4. The Participant is responsible for using the appropriate equipment and software to gain access to the Website and online Services.

5. It is not permitted to:

• Circumvent or hack the security of the Website or online Services;

• Provide incorrect information via the Website (e.g. when creating a profile);

• Use the Website or online Services in a way that may hinder or damage their functioning; and

• Use automated programs, such as bots or scrapers, to gain access to the Website or online Services.

6. The use of certain Websites (e.g. gentrepreneur.startium.be) may be subject to additional terms of use. Those specific terms of use apply in addition to these General Terms and Conditions.

7. Gentrepreneur is not responsible for the accuracy, completeness, or reliability of information shared by other Participants or third parties on its Websites. All information provided by third parties falls under the responsibility of the relevant third party and not under that of Gentrepreneur. In addition, Gentrepreneur is not liable for events or activities organized by third parties, such as sponsors, and shared via a Website.

4. Services and Activities

1. The content, dates, times, and locations of Activities are announced via the Website, newsletters, or other communication channels of Gentrepreneur.

2. Gentrepreneur reserves the right to make changes to the program, content, dates, times, or locations of Activities. Such changes do not give the Participant any right to compensation.

3. Gentrepreneur strives to provide accurate and up-to-date advice during Coachings, but cannot guarantee that shared advice or information is always complete, correct, or current. The advice provided during a Coaching constitutes a personal opinion of a Gentrepreneur coach or staff member. The Participant cannot hold Gentrepreneur or the Gentrepreneur coach or staff member liable for incomplete, outdated, or inaccurate advice.

4. Gentrepreneur reserves the right to refuse to provide Services (including Coachings) to certain persons for ethical reasons, including but not limited to cases where the person’s conduct or business plans conflict with the values and standards of Gentrepreneur. In such cases, Gentrepreneur will, where possible, inform the person concerned of the reason for the refusal.

5. Registrations and cancellations

1. Although Gentrepreneur primarily focuses its Activities on young entrepreneurial persons in Ghent between 18 and 25 years old, or persons at a higher education institution campus in Ghent, participation in Activities is in principle open to everyone, unless stated otherwise. Gentrepreneur may apply specific admission criteria for certain Activities or Services. These criteria will be communicated in advance.

2. Participation in certain Activities requires prior registration. Registration takes place via the Website, a registration website, by email, or in another manner indicated by Gentrepreneur.

3. A registration is only final after confirmation by Gentrepreneur. Gentrepreneur reserves the right to refuse registrations without giving reasons.

4. When registering for events or Activities, Gentrepreneur expects the presence of the Participant. If the Participant is unable to attend, the Participant must inform Gentrepreneur as soon as possible.

5. Cancellation by the Participant must take place by email or in the manner indicated on the Website (e.g. cancellation link). In the event of late cancellation or no cancellation by the Participant, Gentrepreneur reserves the right to charge a reasonable cancellation fee. In case of repeated non-attendance, Gentrepreneur may refuse or cancel the registration of a Participant.

6. Gentrepreneur reserves the right to cancel Activities if there are insufficient registrations or in case of force majeure. In such cases, any participation fees will be refunded.

7. Gentrepreneur expressly reserves the right to refuse or remove persons from Activities without giving reasons, for example in cases of:

• Inappropriate or disruptive behavior

• Failure to follow instructions of staff members or representatives of Gentrepreneur

• Reaching the maximum capacity of a location

• Other circumstances that, in the opinion of Gentrepreneur, hinder the proper course of an Activity

6. Liability

1. Participation in Activities of Gentrepreneur takes place entirely at the Participant’s own risk.

2. Gentrepreneur is not liable for any damage, direct or indirect, suffered by the Participant as a result of the use of the Services of Gentrepreneur or participation in Activities, unless the damage results from intent or deliberate recklessness on the part of Gentrepreneur.

3. Gentrepreneur is in particular not liable for::

• Damage to, loss, or theft of personal belongings during Activities

• Personal injury or accidents during Activities

• Damage resulting from advice or information provided by Gentrepreneur

• Damage resulting from the cancellation or modification of Activities

• Damage caused by other Participants

• Indirect damage, consequential damage, loss of profit, missed savings, or damage due to business interruption

4. The Participant agrees that the Participant cannot bring any direct claim (contractual or non-contractual) against an auxiliary person of Gentrepreneur, including but not limited to Gentrepreneur coaches, staff members, and experts. To the extent necessary, the Participant expressly waives such claims.

5. If Gentrepreneur should be liable for any damage, liability is limited to the maximum amount paid out by Gentrepreneur’s insurer in the relevant case, or, if no payment is made, to a maximum of EUR 10,000.

7. Intellectual property

1. All intellectual property rights relating to the content of the Website, events, presentations, documents, and other materials of Gentrepreneur remain with Gentrepreneur or its licensors.

2. It is not permitted, without prior written consent of Gentrepreneur, to:

• Reproduce, distribute, publish, or modify materials of Gentrepreneur

• Record, copy, or distribute the content of presentations, workshops, or trainings

• Use trademarks, logos, or other distinguishing signs of Gentrepreneur

3. It is permitted to share materials of Gentrepreneur via social media, provided that the source is mentioned and without commercial intent.

8. Privacy and visual material

1. Gentrepreneur processes personal data in accordance with applicable privacy legislation and the privacy statement, which is available on its Websites.

2. During Activities, photos, video and audio recordings may be made for promotional purposes, reporting, and archiving. By participating in Activities of Gentrepreneur, the Participant gives consent for the creation and publication of this material in which the Participant may be recognizably depicted. If the Participant does not wish to be photographed or filmed, the Participant must notify Gentrepreneur in writing prior to the Activity. In such cases, Gentrepreneur will make efforts to avoid showing the Participant recognizably as a portrait, but cannot guarantee this in general atmosphere images or recordings of large groups.

3. Gentrepreneur reserves the right to use image material for its own promotional purposes via the Website, social media, newsletters, and other communication channels, without the Participant receiving any compensation for this.

9. Newsletter and communication

1. By registering for the newsletter, the Participant gives consent to receive periodic updates about Activities, Services, and other relevant information from Gentrepreneur.

2. The Participant may unsubscribe from the newsletter at any time via the designated link in each newsletter or by sending a request to Gentrepreneur.

3. Gentrepreneur may contact the Participant with targeted communication about Activities or Services that match the Participant’s profile or interests (for example, as indicated in the Startium profile).

10. Visibility on the Website

1. Gentrepreneur sometimes offers Participants the opportunity to gain visibility on its Websites, social media, poster and other marketing campaigns. To be eligible for this, Gentrepreneur may set specific conditions and may unilaterally change these at a later stage. Gentrepreneur has the right to unilaterally terminate a campaign or to no longer provide visibility to a Participant without further justification.

2. Gentrepreneur reserves the right to refuse, remove, or adjust profiles without giving reasons.

3. The Participant is responsible for the accuracy and timeliness of the information and image material provided.

4. Gentrepreneur is not liable for any damage resulting from the publication of incorrect or incomplete information about the Participant or their enterprise.

11. Rules of conduct

1. The Participant shall conduct themselves during Activities of Gentrepreneur in accordance with public order, morality, and the rules of normal social conduct.

2. The Participant shall follow instructions and directions of staff members or representatives of Gentrepreneur.

3. The Participant is not permitted during Activities to:

• Behave in a discriminatory, intimidating, or otherwise inappropriate manner towards other participants or staff members of Gentrepreneur

• Distribute material that is contrary to the law, morality, or public order

• Engage in activities that may disrupt the proper course of the Activity (e.g. disruptive / unauthorized marketing practices)

• Engage in commercial activities (e.g. setting up a sales stand, placing banners) without prior consent of Gentrepreneur

4. In case of violation of these rules of conduct, Gentrepreneur may deny the Participant access to the Activity or remove the Participant, without the Participant being entitled to reimbursement or compensation.

12. Amendments to the General Terms and Conditions

1. Gentrepreneur reserves the right to amend or supplement these General Terms and Conditions.

2. Amendments will be published on the Website and take effect immediately. In the event of substantial amendments, Gentrepreneur will inform the Participants via its Website.

3. If, after an amendment of the General Terms and Conditions, the Participant continues to make use of the Services of Gentrepreneur, registers for an Activity, or is present at an Activity, the Participant shall be deemed to have accepted these amendments.

13. Applicable law and disputes

1. These General Terms and Conditions and their application, as well as all agreements and legal acts between Gentrepreneur and the Participant, are governed by Belgian law.

2. In case of disputes, the parties shall first attempt to reach an amicable settlement. If this proves not possible, disputes will be submitted to the competent court of the judicial district of East Flanders, Ghent division.

14. Force majeure

1. Gentrepreneur is not obliged to fulfill any obligation if it is prevented from doing so as a result of force majeure or due to circumstances that severely impede the performance of a Service or Activity. Force majeure includes, among other things: extreme weather conditions, illness of staff members or speakers, government measures, power outages or failures of internet or telecommunication connections, pandemics or epidemics, and other unforeseen circumstances that make the performance of the Activity or Service impossible or irresponsible.

2. In the event of force majeure, Gentrepreneur has the right to cancel, reschedule, or offer Activities in an adapted form, without the Participant being entitled to compensation.

15. Final provisions

1. If one or more provisions of these General Terms and Conditions are at any time wholly or partly null and void or annulled, the remaining provisions of these General Terms and Conditions shall remain fully applicable.

2. In cases not provided for in these General Terms and Conditions, Gentrepreneur shall make arrangements in reasonableness.

3. The most recent version of these General Terms and Conditions is always available on the relevant Gentrepreneur Website.
